For-profit managed care organizations face decisions about cost sharing that can involve a tradeoff between the interests of investors and the interests of patients. No successful business can ignore the interests of its investors, but moral philosophy points to ethical reasons for managed care organizations to make patients’ health, rather than investors’ profit, their primary goal. One reason is the ethical obligation of all businesses to avoid wrongful exploitation of vulnerable customers. An insurance company’s cost-sharing policy can exploit customers either (...) by collecting an unfairly large amount of money from them or by unfairly deterring them from making claims for resources they medically need. Another reason stems from the fact that managed care organizations’ profits derive in part from the existence of artificial barriers to access to medicine, notably including patents. Putting a fence around a water well in the desert is legitimate only if doing so facilitates a financial arrangement that maximizes people’s access to water they need. Likewise, patents and other artificial barriers to access to medically necessary drugs are legitimate only if they are used to help finance access to medical resources people need. For these reasons, managed care organizations should make cost-sharing decisions that maximize the sustainable availability of effective drugs to patients who need them. (shrink)

In Physical Causation, Phil Dowe proposes a Conserved Quality account of causation and offers criticisms of several alternatives, including Humean, counter-factual, and mark transmission accounts. Dowe eschews “conceptual analysis” and instead offers his theory as an “empirical account of causation at it is in the actual world.” Dowe takes this as absolving him of the responsibility of giving an account of the essence of causation, threatening to turn his metaphysical account into a watered-down version of more-or-less contemporary physical theory. Nonetheless, (...) on the basis of the strength of many of the criticisms of alternatives, I can recommend this book to anyone interested in contemporary debate about causation. (shrink)

An analysis of two heuristic strategies for the development of mechanistic models, illustrated with historical examples from the life sciences. In Discovering Complexity, William Bechtel and Robert Richardson examine two heuristics that guided the development of mechanistic models in the life sciences: decomposition and localization. Drawing on historical cases from disciplines including cell biology, cognitive neuroscience, and genetics, they identify a number of "choice points" that life scientists confront in developing mechanistic explanations and show how different choices result in (...) divergent explanatory models. Describing decomposition as the attempt to differentiate functional and structural components of a system and localization as the assignment of responsibility for specific functions to specific structures, Bechtel and Richardson examine the usefulness of these heuristics as well as their fallibility—the sometimes false assumption underlying them that nature is significantly decomposable and hierarchically organized. When Discovering Complexity was originally published in 1993, few philosophers of science perceived the centrality of seeking mechanisms to explain phenomena in biology, relying instead on the model of nomological explanation advanced by the logical positivists (a model Bechtel and Richardson found to be utterly inapplicable to the examples from the life sciences in their study). Since then, mechanism and mechanistic explanation have become widely discussed. In a substantive new introduction to this MIT Press edition of their book, Bechtel and Richardson examine both philosophical and scientific developments in research on mechanistic models since 1993. The Greek philosopher Aristotle, writing over two thousand years before Wall Street, called people who engaged in activities which did not contribute to society "parasites." In his latest work, renowned scholar Robert C. Solomon asserts that though capitalism may require capital, but it does not require, much less should it be defined by the parasites it inevitably attracts. Capitalism has succeeded not with brute strength or because it has made people rich, but because it has produced responsible citizens and--however (...) unevenly--prosperous communities. It cannot tolerate a conception of business that focuses solely on income and vulgarity while ignoring traditional virtues of responsibility, community, and integrity. Many feel that there is too much lip-service and not enough understanding of the importance of cooperation and integrity in corporate life. This book rejects the myths and metaphors of war-like competition that cloud business thinking and develops an "Aristotelean" theory of business. The author's approach emphasizes several core concepts: the corporation as community, the search for excellence, the importance of integrity and sound judgment, as well as a more cooperative and humane vision of business. Solomon stresses the virtues of honesty, trust, fairness, and compassion in the competitive business world, and confronts the problem of "moral mazes" and what he posits as its solution--moral courage. The current debate on “free agency” seems to highlight the romantic aspects of free agent and considers it a genuine response to changing economic conditions (e.g., high-unemployment rate, importance of knowledge in the labor market, the eclipse of organizational loyalty, and self pride). Little attention, if any, has been given to the religious root of the free agency concept and its persistent existence across history. In this paper, the current discourse on free agency and the conditions that have led to (...) its emergence are briefly discussed. The paper focuses on the theological perspectives of Judaism, Christianity, and Islam on the concept. Implications for management and business organizations are provided. (shrink)

In this paper, we explore Fregean metatheory, what Frege called the New Science. The New Science arises in the context of Frege’s debate with Hilbert over independence proofs in geometry and we begin by considering their dispute. We propose that Frege’s critique rests on his view that language is a set of propositions, each immutably equipped with a truth value (as determined by the thought it expresses), so to Frege it was inconceivable that axioms could even be considered to be (...) other than true. Because of his adherence to this view, Frege was precluded from the sort of metatheoretical considerations that were available to Hilbert; but from this, we shall argue, it does not follow that Frege was blocked from metatheory in toto. Indeed, Frege suggests in Die Grundlagen der Geometrie a metatheoretical method for establishing independence proofs in the context of the New Science. Frege had reservations about the method, however, primarily because of the apparent need to stipulate the logical terms, those terms that must be held invariant to obtain such proofs. We argue that Frege’s skepticism on this score is not warranted, by showing that within the New Science a characterization of logical truth and logical constant can be obtained by a suitable adaptation of the permutation argument Frege employs in indicating how to prove independence. This establishes a foundation for Frege’s metatheoretical method of which he himself was unsure, and allows us to obtain a clearer understanding of Frege’s conception of logic, especially in relation to contemporary conceptions. Quons are particles characterized by the parameter q, which permits smooth interpolation between Bose and Fermi statistics; q = 1 gives bosons, q = -1 gives fermions. In this paper we give a heuristic argument for an extension of conservation of statistics to quons with trilinear couplings of the form ffb, where f is fermion-like and b is boson-like. We show that q f 2 = qb. In particular, we relate the bound on qγ for photons to the bound on (...) qe for electrons, allowing the very precise bound for electrons to be carried over to photons. An extension of this argument suggests that all particles are fermions or bosons to a high precision. (shrink)

This book sets the record straight about the greater influence of Dilthey than Husserl in Heidegger’s initial formulation of his conception of phenomenology. Scharff shows how, in Heidegger’s early lecture courses, phenomenology is presented as a genuine philosophical alternative, and explores our own current need for a phenomenological philosophy.

The formal framework of Kauffman (1991) depicts the constraints of self-organization on the evolution of complex systems and the relation of self-organization to selection. We discuss his treatment of 'generic constraints' as sources of order (section 2) and the relation between adaptation and organization (section 3). We then raise a number of issues, including the role of adaptation in explaining order (section 4) and the limitations of formal approaches in explaining the distinctively biological (section 5). The principal question we pose (...) is the relation of generic constraints on evolution to more specific local constraints, imposed, for example, by the characteristic materials out of which organisms are constructed, the accidental features characteristic of the Bauplan of a lineage, and the local vicissitudes of adaptation. This article and the following ones by Slife and Westerman represent a coordinated effort on the authors' part to begin to mine the resources of what has been termed the "practice turn in contemporary theory" for psychology. The liberal approach tends to focus on a fear of power and how it can corrupt our best ideals, while the postmodernist tends to focus on a fascination with power flowing through the social and institutional expressions of these very ideals. Given modern Western (...) culture's deep antiauthoritarian tenor, these two responses can be seen as reflecting what might be termed an underlying "control or be controlled" dilemma. We suggest the practice turn and hermeneutics offer an avenue for effectively getting past this basic dilemma. They make it clear that in everyday life, we are both profoundly shaped and influenced by the world and other people and influence them, in turn, by the way we interpret them and adjust to them as we engage in the fields of practices in which we find ourselves. Personal and social influences at play in the everyday business of human living create a continuum rather than a dichotomy regarding issues of control and power, leading to a dissolution of our taxing "control or be controlled" dilemma. Such an ontology clearly entails rethinking some prominent cultural ideals, leading us perhaps to think as much or more in terms of character than achievement, of cooperation than competition, of patience than striving restlessly to get somewhere. 2012 APA, all rights reserved). The past two decades have seen an outpouring of work in legal theory that is self-consciously critical of aspects of American law and the institutions of the liberal state. In this lively volume, eminent scholars in philosophy, law, and political science respond to this recent scholarship by exploring what constitutes a "radical" critique of the law, examining such theories as critical legal studies, feminist theory and theories of "difference," and critical race theory. The authors consider whether the critiques advanced in (...) recent legal theory can truly be called radical and what form a radical critique of American law should take. Writing at the cutting edge of the critique of critical legal theory, they offer insights first on critical legal scholarship, then on feminist political and legal theory. A third group of contributions questions the radicalness of these approaches in light of their failure to challenge fundamental aspects of liberalism, while a final section focuses on current issues of legal reform through critical views on criminal punishment, including observations on rape and hate speech. Each major essay describes the underlying principles in the development of a radical legal theory and addresses unresolved questions relating to it, while accompanying commentaries present conflicting views. The resulting dialogue explores wide-ranging issues like equity, value relativism, adversarial and empathic legal advocacy, communitarianism and the social contract, impartiality and contingency, "natural" law, and corrective justice. Many philosophers of science and technology who see themselves as coming “after” Husserl also claim that their phenomenology is hermeneutical. Yet they neither practice the same sort of phenomenology, nor do they all have the same understanding of hermeneutics. Moreover, their differences often seem to be more a function of different pre-selected substantive commitments—say, to take a “material” turn or to be resolutely “empirical”—than the product of any serious effort to clarify what it is be hermeneutical. In this essay, after (...) some discussion of Dilthey’s reception among post-Husserlians (especially Patrick Heelan and Don Ihde), I consider how aspiring hermeneuts might make their own pre-possession of substantive and methodological commitments a hermeneutical topic. This is, of course, is not just a scholarly question of how post-Husserlian phenomenologists might make themselves more phenomenological. Without thoughtful self-awareness of these commitments, one’s assumptions about the use of technology, design, the place of science in the larger culture and in relation to conceptions of human flourishing—all of these assumptions are likely to pass through into technoscientific practice with insufficient critical consideration. The Endosomal Sorting Complexes Required for Transport (ESCRTs) drive membrane remodeling in a variety of cellular processes that include the formation of endosomal intralumenal vesicles (ILVs) during multivesicular body (MVB) biogenesis. During MVB sorting, ESCRTs recognize ubiquitin (Ub) attached to membrane protein cargo and execute ILV formation by controlling the activities of ESCRT‐III polymers regulated by the AAA‐ATPase Vps4. Exactly how these events are coordinated to ensure proper cargo loading into ILVs remains unclear. Here we discuss recent work documenting the (...) ability of Bro1, an ESCRT‐associated Ub‐binding protein, to coordinate ESCRT‐III and Vps4‐dependent ILV biogenesis with upstream events such as cargo recognition. Phenomenologists usually insist that their approach involves going “back” to and “starting” with technoscientific experience—that is, returning to the actual existing or living through of technoscientific life—after centuries of privileging the analysis of how things are “objectively” known and denigrating accounts of how they are “subjectively” lived with. But then who says this and how is this understood? “Who” is really a phenomenologist, when so many diverse thinkers claim the title? Each essay concentrates on a single work, and the volume is organized on a chronological principle, considering the works in the order in which Nietzsche wrote them. Among the contributors are many Nietzsche scholars, including Ivan Soll, Alexander Nehemas, Frithjof Bergmann, and Arthur Danto. Some of the most intriguing issues in the study of cognitive, social, emotional, and physical development arise in the debate over nature versus nurture; a debate difficult to resolve because it is difficult to separate the respective contributions of genes and environment to development. The most powerful approach to this separation is through longitudinal adoption studies. The Colorado Adoption Project is the only longitudinal adoption study in existence examining development continuously from birth to adolescence, which makes it a unique, powerful, (...) and tremendously valuable resource. The turn of the nineteenth century marked a rich and exciting explosion of philosophical energy and talent. In this essay, I want to reconsider sympathy as a “natural” emotion or sentiment. Adam Smith famously defended it as such (as did his friend David Hume) but both used the term ambiguously and in a different sense than we use it today. Nevertheless, it seems to me that Smith got it quite right, that the basis of morality and justice is to be found in the realm of affect rather than in theory and principles alone, and that sympathy is (...) a “natural” or should we say a “basic” emotion. But that means that morality may not be an exclusively human characteristic, as many philosophers (including Smith and Hume) have assumed. But some contemporary thinking in psychology and philosophy makes that extension plausible. (shrink)
